$1,000 Trade Me shopping spree terms

1. Acceptance of terms: These terms and conditions (“Terms”) are between Trade Me Limited (“Trade Me”) and you. If you buy an Eligible Item on Trade Me’s marketplace during the Promotion Period, you agree to the Terms.
2. Promotion Period: The “Promotion Period” means the period starting at 12.00am on 9 October 2017 and ending at 11.59pm on 15 October 2017. At Trade Me’s absolute discretion, the Promotion Period may be extended. If Trade Me extends the Promotion Period, it will give reasonable notice of this via advertising and messaging on Trade Me’s marketplace and will update these Terms.
3. Eligibility: During the Promotion Period, Trade Me will be giving buyers the chance to win one of seven $1,000 Trade Me shopping sprees (each a “Prize”, as further described in clause 7). You will be entered into the draw to win a Prize if you:
   1. purchase an item from Trade Me’s general items marketplace (an “Eligible Item”) for your own personal use (and not for any organisation, business or other enterprise) during the Promotion Period; and
   2. are a New Zealand citizen or resident aged 18 years or older.
   Each purchase of an Eligible Item entitles you to one “entry” into a daily prize draw, so the more you buy, the better your chance to win the Prize. Trade Me staff and their immediate families are not eligible to win a Prize. You may only win one Prize. For the avoidance of doubt, Trade Me’s general items marketplace does not include: (a) vehicles or large machinery listed in the Business, Farming and Industry category; or (b) items listed on Trade Me Motors, Trade Me Property or other similarly distinct areas of Trade Me’s marketplace.
4. Prize draws: There will be seven daily Prize draws during the Promotion Period. Each Prize draw will consist of all the valid entries received during a particular day during the Promotion Period. The Prize winners for each day of the Promotion Period (each a “Winner”) will be randomly picked by the Trade Me team on Monday 16 October (the “Draw Day”).
5. Contacting Winners: Trade Me will contact each Winner on or before 5pm on the Draw Day (using the Winner’s contact details registered with their Trade Me membership). Contact may be made by email or phone (or both). If the Winner does not respond to Trade Me and accept the Prize within seven days of being contacted by Trade Me, that Winner forfeits his/her right to the Prize and Trade Me may pick an alternative Winner and contact them. If there is a dispute about the Winner, you agree that Trade Me’s decision regarding the Winner is final.
6. Winner announcements: If you are picked as the Winner, Trade Me may use your first name and location when announcing you as the Winner and in promotional material, such as on Trade Me’s website, in Trade Me’s emails, Trade Me’s Newsroom, and on social media.
7. Nature of the Prize: No later than 30 days after a Winner accepts their Prize in accordance with clause 5, Trade Me will pay that Winner $1,000 (the “Prize Money”) via bank transfer subject to the following conditions:
   1. the Winner must provide Trade Me with the details of the bank account where they would like the Prize Money paid;
   2. before Trade Me pays the Prize Money to the Winner, the Winner must use the Watchlist on their Trade Me membership to add any items listed on Trade Me’s general items marketplace (cumulatively up to the value of the Prize Money, including shipping costs) that they that they plan to purchase with the Prize Money (“Intended Purchases”);
   3. Trade Me will pay the Winner the Prize Money once the Winner has notified Trade Me of the Intended Purchases and provided their bank account details (in accordance with clauses 7.1 and 7.2 above). The Prize Money may not appear in the Winner’s bank account for up to three working days; and
   4. the Winner is only entitled to spend, and will only spend, the Prize Money on the Intended Purchases.
8. Liability: To the fullest extent permitted by law, Trade Me shall not be responsible for any loss, damage or injury whatsoever suffered by you in respect of the subject matter of this Agreement (including but not limited to any direct, indirect, consequential, special, punitive or incidental loss or damages) and Trade Me’s liability to you will be limited to the value of the Prize. For the avoidance of doubt, nothing in this Agreement is intended to modify or negate a consumer's rights under the Consumer Guarantees Act 1993.
9. Termination: Without limiting any actions that may be taken under the Trade Me terms and conditions, Trade Me may immediately terminate this Agreement by notice to you if you breach this agreement, or engage in conduct that Trade Me (acting reasonably) deems inappropriate or unacceptable or likely to damage the reputation or goodwill of Trade Me.
10. Other terms: The Trade Me terms and conditions (as amended from time to time) apply with all necessary modification to this Agreement.
11. Privacy: Your information collected by Trade Me for the purposes of this Agreement is held and used by Trade Me subject to Trade Me’s privacy policy.
