Labour weekend no success fee terms
- Acceptance of terms: These terms and conditions (“Terms”) are between Trade Me Limited (“Trade Me”) and you, and you agree to them If you list an Eligible Item on Trade Me’s online marketplace at any time (during NZST) between 21 - 23 October 2017 (“Labour Weekend”).
- No success fee for non-professional sellers: Unless you are a professional seller or are selling an item “in trade” (as that term is understood in the Consumer Guarantees Act 1993), Trade Me will not charge you a success fee for any Eligible Item that you sell on Trade Me’s online marketplace which is listed on Labour Weekend. An “Eligible Item” means an item that belongs in a category found in Trade Me’s general items marketplace. For the avoidance of doubt, Trade Me’s general items marketplace does not include items listed on Trade Me Motors, Trade Me Property or other similarly distinct areas of Trade Me’s online marketplace.
- Other fees still apply: Despite clause 2, if you list an Eligible Item on Labour Weekend you will still be liable to pay:
- a withdrawal fee if you withdraw an Eligible Item that you listed on Labour Weekend which was not sold to a Trade Me member;
- success fees on any re-list of an Eligible Item that was originally listed on Labour Weekend;
- success fees on any item that is sold by you during Labour Weekend which was listed before or after Labour Weekend; and
- any applicable charge for the use of a payment service on Trade Me’s online marketplace (e.g., Pay Now, Ping or Afterpay);
- any applicable high volume listing fees;
- for any promotional extras that you purchase in relation to a listing; and
- any applicable classified fee for a classified listing.
- Commercial use prohibited: Your access to success fee free listings during Labour Weekend (as described in clause 2) is conditional upon items that you list being listed for your sole personal, non-commercial benefit. Trade Me may charge you any relevant success fees, and take any other action permitted by the Trade Me terms and conditions, if Trade Me reasonably believes that:
- you are an “in trade” seller and have taken actions to attempt to avoid paying success fees in connection with the listing of items on Labour Weekend (including by creating a new account or changing your “in trade” status as displayed to users of Trade Me);
- due to the volume or nature of the items that you have listed during Labour Weekend, you are not using your membership for your own personal, non-commercial use;
- you have attempted to transfer or re-sell the benefit of success fee-free listings (as described in clause 2) to any other person in any way; or
- you have let any other person use your Trade Me membership for the purpose of that person avoiding paying success fees.
- Termination: Without limiting any actions that may be taken under the Trade Me terms and conditions, Trade Me may immediately terminate this Agreement by notice to you if you breach this agreement, or engage in conduct that Trade Me (acting reasonably) deems inappropriate or unacceptable or likely to damage the reputation or goodwill of Trade Me.
- Other terms: The Trade Me terms and conditions (as amended from time to time) apply with all necessary modification to this Agreement.
- Privacy: Your information collected by Trade Me for the purposes of this Agreement is held and used by Trade Me subject to Trade Me’s privacy policy.
