Terms and conditions: Variety – the Children’s Charity & Coast’s Celebrity Bake Sale

By placing a bid on any of our Celebrity Bake Sale auctions, you are confirming that you understand and accept the following Terms and Conditions:

1. Charitable Purpose Private Sale

1.1          Variety – the Children’s Charity (“Variety”) operates the Trade Me account "Variety Charity" for charitable purposes only. 

1.2          The sales of ‘Bake Sale baking by’ (“Goods”) facilitated by Variety and NZME (together, “the Organisations”) via the Variety Charity Trade Me account are private sales.  The Organisations are not in trade in relation to any Goods being auctioned.

2. Payment

2.1          If you are the successful bidder for an auction for any Goods, payment must be received within 7 days via bank transfer to Variety – the Children’s Charity, prior to the dispatch for delivery or pick up of the Goods. Bank details will be provided to the successful bidder via email.

2.2          If payment is not received within 7 days of the closing date of an auction, the Organisations reserve the right to relist the Goods via Trade Me or any other medium.

3.  Delivery

Delivery of Goods will be completed upon delivery of Goods to the address you specify (which must be a physical address in New Zealand) or at the time you pick up the Goods at our authorised collection site.

4.  Risk and title

4.1          The risk of loss, damage, or destruction of the Goods will pass to you on delivery, and the Organisations will not be liable for any loss or damage to the Goods arising following delivery.

4.2          Title to the Goods will remain with the Organisations until the later of:

a        delivery; and

b        when payment is received in full of the price for such Goods,

and you acknowledge that part-payment of any amount for the Goods does not convey any part, right, title, and/or interest in the Goods.

5. Warranty and Liability

5.2          The Organisations have made reasonable efforts to ensure that the description of Goods in each listing is correct, and condition of the is Goods described accurately and fairly. The Goods are handcrafted and may have minor imperfections.  To the maximum extent permitted by law, the Organisations provide no warranties in respect of the Goods (either express or implied).  The Consumer Guarantees Act 1993, Fair Trading Act 1986, Contract and Commercial Law Act 2017 and other statutes may imply warranties, conditions or terms on the Organisations, which, where permitted, are excluded or will only apply up to the minimum extent required by that statute.

5.3          The Goods outlined in each listing are intended to be used as a bed and bedding only. The Organisations accept no liability or responsibility of any kind for any defect with the Goods (including in manufacture or faulty workmanship) nor for any loss or damage whatsoever suffered (including, but not limited to, direct, indirect, special, punitive or consequential loss or damages) which is suffered or sustained in connection with Goods and the use of the Goods, to the fullest extent available by law.
