All prices (unless specified) include GST and exclude freight. Prices are subject to change without notice (Error & Omissions Excepted).

Agreement Newlands Group Ltd agrees to sell and the Customer agrees to buy the goods ordered.

Acceptance By placing the order for goods through Newlands Trademe Store you are deemed to accept our terms and conditions of sale.

Price

• The purchase price is for goods supplied and packed, and is exclusive of installation and maintenance.
• The price you pay will be increased by the amount of GST, other taxes and duties which may be applicable and insurance/freight/handling charges (except to the extent already expressly included in the price).
• We can revise our prices at any time prior to accepting your order.
• Purchase prices are given in New Zealand dollars unless otherwise stated.
• You are bound to pay us the price once we accept your order. A quotation does not give rise to a binding contract until you place an order which we subsequently accept.

Payment

• Please ensure the auction number is used as a reference against your payment. If you do not put the auction reference number against your payment this will take longer for your goods to be dispatched.
• Credit card (We accept Visa and Mastercard on all auctions. Our ‘after auction’ email will provide details on how to do this via telephone)
• Payment must be made within 2 days of auction/sale finishing.

Delivery – Tools and general goods

• Where we agree to transport the goods to a specified place, we will deliver, or arrange delivery of, the goods to that place.
• Delivery shall take place at the time when the goods are made available for despatch at our premises.
• If we are to deliver the goods by instalments, and each instalment shall be treated as a separate contract.
• Any time stated for delivery is an estimate only. No claim can be made by you on account of late shipment, or delivery however caused.
• All freight charges shall be at your cost unless otherwise agreed and stated.

Delivery – Batteries and dangerous goods

• It is free to collect a battery from one of Newlands branches during normal office hours. Please contact us if you require an alternative pick up time.
• Wet Flooded Car, Truck, Deep Cycle, Motorbike and Jet ski batteries are considered Dangerous Goods. As such we can only use accredited dangerous goods carriers to deliver them safely. Due to this it may take one or two days longer to deliver your items, than non-dangerous goods carriers. Please let us know if you require alternative delivery options.

• All goods to be returned must have a Goods Return Authority issued by us prior to return. The issue of a Goods Return Authority does not guarantee that we will accept the return rather it is our agreement to receive the product back to review your claim.
• Where a Good Return Authority has been issued you have 14 days to return the goods to us. Once received we will review your claim and respond with our findings and the next steps within 7 days.
• Any faulty good will be subject to the normal return procedures for the specific manufacturer brand being returned, and if agreed with the manufacturer that the product is faulty we will issue a credit within 7 working days.
• Non-faulty product will require a Goods Return Authority, must be in saleable condition, as deemed by us, and will be subject to a minimum 10% restocking fee. Freight charges will not be credited under any circumstances.
• You will be liable for all delivery and insurance charges incurred in respect of returned goods.
• Only where incorrect good are sent by us in error will we provide a full refund of the purchase price.

• Newlands Group Ltd is proud to offer a quality range of products online via Trademe. We may offer ex demonstration and shop-soiled items for sale with a limited warranty via online means and where we do this will be clearly stated.
• All new/unused goods purchased are covered by a full manufacturer’s warranty.
• Warranties cover manufacturing faults and defects. They do not cover damage caused by electrical faults or physical damage, any form of modification, normal wear and tear, sulphation, incorrect application, negligence, failure arising from the addition of fluids.
• On the rare occasion that a product is found to be faulty under warranty, not as described or any other issues arise with your order, please contact us via email immediately so we can promptly remedy the issue for you.

To keep this process easy you must provide us with clear proof of purchase. The proof of purchase may either be a receipt we issued, or bank statement or credit card statement where the amount shown on the statement directly corresponds with the purchase price of the product.

• In many cases to process a possible warranty issue the item will need to be returned to determine the cause. The return of the item is the responsibility of the customer, if the fault is found to be a manufacturing defect any return costs will be reimbursed. Please see our Returns Policy for more details.
