• Please ensure the auction number is used as a reference against the deposit. If you do not put the auction reference number against the deposit this will take longer for your goods to be dispatched.
• Credit card payment at the close of auction using the Pay Now option only
• Payment must be made within 5 business days of auction/sale finishing or goods will be relisted.

Agreement

• Computer Leasing Limited (CLNZ) agrees to sell and the Customer agrees to buy the goods ordered through CLNZ.

Acceptance

• By placing the order for goods through CLNZ you are deemed to accept the terms and conditions of sale.

Price

• The purchase price is for goods supplied and packed, and is exclusive of installation and maintenance.
• Purchase prices are given in New Zealand dollars.

Risk and delivery

• You are responsible for insurance and risk in the Products from the time they are delivered to you or your nominated agent. Where you have assumed responsibility for carriage then responsibility falls to you when the Products are collected by you or your nominated agent.
• You agree to pay all delivery costs.
• All claims for shortage or damage during delivery must be made to the carrier within 7 days of the date of delivery. Where goods appear to be damaged or missing you must contact the carrier and CLNZ immediately.
• CLNZ will make every effort to ensure delivery of Products, or performance of services, is on time, but will not be liable to you for any loss or damage arising in any way from any delay in delivery or performance. Delay in delivery or performance shall not entitle you to cancel any order.
• Unless otherwise stated in writing, all Products will be box shipped and it is your responsibility to assemble, configure and install them.
• Where you ask CLNZ to deliver goods directly to another person, that person takes possession of the goods for you as your agent, but you are still directly responsible to CLNZ under these terms of trade.
• All delvieries are signature required, Monday to Friday via overnight courier.

General

• CLNZ reserves the right to change these terms of trade from time to time.
• If CLNZ fails to enforce any terms or to exercise its rights under these terms of trade at any time, CLNZ has not waived those rights.
• If any provision of these terms of trade is held to be invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect and the parties shall adjust their respective rights and obligations in accordance with the spirit and intent of the parties as shown by these terms of trade.
• This agreement is governed by the laws of New Zealand and any dispute under it shall be subject to the exclusive jurisdiction of the Courts of New Zealand.
• In these conditions, "Software" includes all relevant documentation, manuals, printed and written matter; "Supplier" means CLNZ's suppliers; "Products" means computer hardware, peripherals, accessories, Software and other goods of any kind which are supplied by CLNZ to you; "Website" means any internet website owned and operated by CLNZ.
• Where you purchase any Products presented on the Website or otherwise use the Website, the Website trading terms shall apply. In the event of any conflict between these terms of trade and the Website trading terms, these terms of trade shall prevail. Where you acquire goods or services supplied by other parties through the Website or through links on the Website, you do so on the condition that CLNZ is not liable to you in any way for those goods or services.

Indemnity

• You hereby indemnify and will keep us indemnified against all obligations and liabilities incurred by an act or omission by you in relation to this agreement.

Other agreements

• These terms apply to all transactions where we supply goods to you.
• This agreement supersedes the terms of all prior agreements, understandings, representations or warranties previously given by us or any agent of CLNZ in respect of goods.
• If there is any inconsistency between these terms and any order submitted by you or any other arrangement with us, these terms prevail unless otherwise agreed by us in writing.
• If at any time any provision of this agreement becomes illegal, invalid or unenforceable neither the legal validity nor enforceability of the remaining provisions shall in any way be affected or impaired.

Waiver

• If we exercise or fail to exercise any right or remedy available to us, this shall not prejudice our rights in exercising that or any other right or remedy. Waiver of any term of the contract must be specified in writing by us and signed by an authorised person.

Returns

• You acknowledge and agree that returns shall only be accepted by CLNZ in accordance with CLNZ's returns policy as notified to you from time to time, and that you may receive a credit for goods returned only with the written consent of CLNZ.
• Where a faulty product is returned and you have requested the right to return to CLNZ within 7 working days of despatch and received written consent from CLNZ, and the returned product has not been used or opened or otherwise deemed unsalable by CLNZ you will be credited in full, unless the return is due to an error by CLNZ, freight charges will not be credited under any circumstances.
• Faulty goods will be subject to the normal return procedures for the specific brand being returned.
• Non-faulty product will require a written permission to return from CLNZ and must be in saleable condition, and will be subject to a minimum 10% restocking fee. Freight charges will not be credited under any circumstances.
• You will be liable for all delivery and insurance charges incurred in respect of returned goods.

Warranties

• Goods are subject to the manufacturers' warranties only, whilst in the qualifying period. CLNZ will pass on the benefit of those warranties to you, without itself being directly liable to you under any warranty.
• Where goods are subject to a return to base warranty, you are responsible for returning them to CLNZ or the manufacturer (as provided by the warranty).
• Any warranty may be voided by damage to or misuse of the system, problems caused by the use or misuse of software, negligent installation or operation, inadequate packaging, cleaning or maintenance, unauthorised repairs, modifications or the addition of incompatible hardware.
• CLNZ does not make any warranty regarding the processing, provision, receipt or exchange of date data by any Products, and CLNZ shall not be liable to you or your customers (subject to any rights they may have under the Consumer Guarantees Act 1993) for any reason whatsoever for any failure of the Products in connection with dates.
• CLNZ reserves the right to repair, replace or refund the cost of equipment
• Warranties are parts only excluding software support and labour and exclude software support, configuration or support.
